The website www.ladecheteque.mu, hereinafter referred to as La Déchetèque is a dematerialized platform, whose purpose is to promote the reuse of materials from construction sites, rehabilitation and / or deconstruction, surplus stock of companies in all sectors of activity.
La Déchetèque offers an internet service for posting and consulting ads for materials available for reuse, intended for professionals in the construction and public works sector, industrials, individuals and NGOs, and other players in the circular economy.

Thanks to La Déchetèque, professionals of the building sector, industrials, individuals and actors of the circular economy can :

The present General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) govern the relations between the various Users of La Déchetèque in the context of the donation, sale, purchase or reception of Materials. The Users are designated, hereafter, as the “User-sellers” and the “User-buyers”. It is also common to refer to them as “Supplying Users” and “Receiving Users”.

LADECHETEQUE.MU – Terms and Conditions

By accessing and using our marketplace, you hereby agree to be bound by the following terms and conditions including all the policies mentioned hereunder (hereinafter referred to as the “Terms & Conditions”). In case you do not accept to be bound by these Terms & Conditions, you may not use our market place including any services provided hereunder.

Our market place accessible on https://ladecheteque.mu (hereinafter referred to as the “Market place”) is owned and operated by La Déchetèque Ltée, a company having its registered office at Avenue des Hirondelles Flic en Flac and bearing Business Registration Number C21180276 (hereinafter referred to as “the Company”).

The Terms & Conditions apply to any person visiting the market place, submitting any order and/or purchasing any products from the market place (hereinafter referred as “you” or “the Customer”).

PAYMENT OPTIONS

We accept Credit Cards and bank transfer as mode of payment. All payments are secured by SSL (Secure Socket Layer).

ladecheteque.mu processes payment through MIPS MyPay who does not store card details. MIPS My Pay is a PCI (Payment Card Industry) compliant payment ecosystem.

When you choose an online payment option, your card information is securely processed through the payment gateway.

Rest assured that your card is safely encrypted as it travels over the Internet.

All payment shall made when placing an order by credit card or bank transfer. 

The bank details of the Company shall be communicated to you at checkout and in the order confirmation email. When proceeding with the bank transfer, you shall include the “order number” in the transaction reference. It might take 48 hours to confirm payment with bank transfer.

A receipt of payment shall be sent by email.

Important: It is the buyer’s responsibility to verify, under 48 hours, that payment corresponds to what should have been paid and that payment has well been done. No reclamation can be made to MIPS after 48 hours.

Please note that La Déchétèque receives a 20% commission on the sale of products online, an essential contribution to support our efforts in the reuse and recovery of materials, as well as to operate our service in a sustainable manner.

WARRANTY AND LIABILITY

 The Company makes no warranty that:

(i) the market place will meet your requirements;

(ii) the market place will be uninterrupted, timely, secure, error-free or free from computer virus or other invasive or damaging code; and

(iii) the quality of the Products, information or other material purchased or obtained through the market place will meet your expectations.

The Company shall not be liable for the unavailability of the market place and/or the Products.

 The Company shall not be deemed to be in breach of the Terms and Conditions as a result of any delay in the performance or failure to perform its obligations in the event such a failure or delay is due to any cause or circumstance beyond its reasonable control, including but not limited to, fire, flood, cyclone, epidemic/pandemic, strikes, riot, road accident, disruption of energy supply, breakdown of equipment or any other act that constitutes a force majeure.

 Whilst the Company takes reasonable precautions in its operations of the market place, neither the Company nor its directors, shareholders, representatives, employees or officers shall assume any responsibility and be liable for any damages to or for viruses that may infect your computer equipment or other property on account of your access to, use of, browsing, or download of any material from the market place.

 The Company shall use its best efforts to screen or edit all the content available from the market place to ensure that there is no illegal, defamatory or obscene content. You are encouraged to inform the Company of any content on the market place that may be offensive or illegal. You hereby agree to hold the Company harmless from any claims arising thereof.

 The Company shall not be held liable for any direct, indirect, incidental or consequential damages (including but not limited to any loss of profits, loss of revenue, loss of operation time, or loss of information or data) sustained by you as a result of your use of or inability to use the market place.
